Frequently Asked Questions

Many people feel uncertain after an injury, especially when they are managing pain, appointments and time away from work. Below are common questions we hear every day. For clarity about your situation, please get in touch for a free, no-obligation chat. We’re here when you need us.

  • Strict time limits apply under Queensland personal injury law. Most injured people have three years to start court proceedings; however the following time limits apply for other claims:

    • Motor vehicle accident claims require a Notice of Accident Claim Form within nine months, or one month after seeing a lawyer.

    • WorkCover claims must be lodged within six months.

    • Public liability claims usually require notice within nine months.

Because rules vary, seeking legal advice early is recommended.

  • Useful material includes medical records, details of injuries sustained, photographs, incident reports, receipts for medical expenses, proof of lost wages and any medical and other evidence from your health practitioner or other health practitioner. These documents help personal injury compensation lawyers assess the claims process and confirm whether someone else’s negligence caused the harm.

  • Compensation may cover medical bills, rehabilitation costs, future medical expenses, lost wages, and the impact of physical injuries and psychological injuries. Some cases, such as a workers' compensation claim, may also include support for permanent disability, serious injury or total and permanent disability. Every assessment depends on the nature and severity of the injuries and the circumstances.

  • Many insurance claims are handled by experienced compensation lawyers, so clients often have limited contact with insurers. Most matters are settled without a hearing, although a court hearing may be necessary if needed. This applies whether the case involves a car accident, motorcycle accident, motorbike accident, truck accident, bus accident or injuries from someone else’s negligence.

  • A no win, no fee guarantee usually means you do not pay legal fees unless you receive compensation. Some arrangements cover uplift fees, disbursements paid upfront and all the costs involved in pursuing compensation. This allows people who have suffered unexpected injury to access legal services without upfront costs or financial hardship across Pacific Pines, Maudsland and surrounding suburbs.

Although Queensland law allows an uplift fee of up to 25%, Biddle Law chooses not to apply one. Serving clients in Pacific Pines, Maudsland and nearby areas, we cap professional fees at 35% rather than the permitted 50%. This ensures a larger share of any settlement remains with the client.
