Estate administration is the legal process of managing and finalising a person’s affairs after they pass away. It covers collecting assets, settling debts and taxes, and distributing what remains to the beneficiaries named in the Will or entitled under Queensland intestacy law. Done properly, it protects everyone involved and closes the estate cleanly.
Most people take on an executor role only once in their lives, often while grieving and without a clear idea of what the job involves. If you have been appointed executor, named in a Will, or left to sort out a loved one’s affairs without one, early legal advice prevents costly missteps.
Acting quickly also matters when there is property to secure, jointly held accounts, business interests, or beneficiaries waiting on distributions. A lawyer can confirm your duties, deal with the banks and Supreme Court of Queensland, and keep the estate moving forward.
Howard Biddle works directly with every client, guiding executors through asset collection, creditor notices, estate accounts, tax obligations, and final distributions under Queensland law. You get practical advice in plain English, not legal jargon or generic templates.
As a local Gold Coast practice, we offer fixed fees with a clear estimate before you commit. You deal with the same lawyer from first call to final distribution, which makes a real difference when the matter is personal and the stakes matter.

An executor’s job is to collect the deceased’s assets, pay any outstanding debts and taxes, keep proper records, and distribute what remains to the beneficiaries named in the Will. You are also responsible for acting in the beneficiaries’ best interests and complying with Queensland law. Our Gold Coast estate administration lawyers can take care of the legal steps and help you meet every obligation correctly.
A simple Gold Coast estate is often administered within six to twelve months. Larger estates involving property, business interests, testamentary trusts or contested assets can take longer. The earlier you get organised, the smoother the timeline. We give you a realistic estimate during your first consultation so you know what to expect.
When there is no valid Will, the estate is distributed under the intestacy rules in Queensland’s Succession Act. A family member usually applies to become the administrator so the estate can be dealt with lawfully. Our team can advise on who is entitled to apply, prepare the application, and manage the estate on the administrator’s behalf.
Executors can generally recover reasonable expenses from the estate and, in some cases, claim commission for their time and trouble. Commission usually requires the beneficiaries’ consent or a court order. We can explain when commission is appropriate and make sure your records support any claim.
You are not legally required to use a lawyer, but estate administration involves court applications, tax obligations, creditor notices and personal liability for mistakes. Most executors find the cost of a fixed-fee lawyer is small compared with the risk of getting it wrong. We offer transparent pricing so you can weigh it up properly.
We offer fixed-fee estate administration services with a clear quote provided before you engage us. The fee depends on the size and complexity of the estate, including the assets involved and whether a court application is required. You will never be surprised by a bill, and we explain every cost in plain English.
