A public liability claim can arise when you are injured because a business, council, occupier or property owner failed to take reasonable care. This includes slips, trips, falls, and accidents in public or commercial spaces where the responsible party owed you a duty of care. Compensation is usually paid through the responsible party’s public liability insurance rather than out of their own pocket.
Responsibility rests with whoever controlled the location where you were injured. That might be a shop owner, body corporate, property manager, event operator, or local council. Most of these entities carry public liability insurance, and part of our job is identifying the correct party and insurer so your claim is directed to the right place.
Strict time limits apply. In most cases, a written notice of claim must be given to the responsible party within nine months of the incident, and court proceedings must be commenced within three years. Because these limits are enforced strictly, getting legal advice as early as possible is important.
Useful evidence includes photos of the hazard and the scene, names and contact details of any witnesses, copies of incident reports, and records of all medical treatment. Payslips or tax records help document any lost income, and keeping receipts for out-of-pocket expenses is worthwhile. The earlier this material is collected, the stronger your claim position.
